"Brite-Klissourska Brooks", "we", "us", and "our" refer to Brite-Klissourska Brooks recruitment services and service platform, which is available on this web site.
You may utilize certain limited features of this Site without registering for an account. If you do so, you expressly agree that all of the terms and conditions of this Agreement, except for Sections 1, and 2 apply to your use of the Site. YOUR USE OF THE SITE SIGNIFIES THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THIS AGREEMENT. IF YOU DO NOT ACCEPT AND AGREE TO THIS AGREEMENT, YOU MAY NOT USE THE SITE.
Certain features, functionality, and content on the Site are only available to users who have registered for an account on the Site (an "Account"). You may register for given types of Accounts, in which case all of the terms and conditions of this Agreement, will apply in their entirety. BY REGISTERING FOR AN ACCOUNT, YOU SIGNIFY THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO ALL OF THE TERMS AND CONDITIONS IN THIS AGREEMENT.
1. ACCOUNTS
There are two main groups of user Accounts available on the Site Accounts for professionals (candidates) and Accounts for companies(hireres). You may register for an Account for which you are eligible by going to, providing the requested information, and submitting your registration application to us. Professional (Candidate) Account. Professionals who are at least eighteen (18) years of age are eligible to register for an Professional Account, which may be used for the sole purpose of seeking contract or full-time work, career information, and related services. Professionals may be individuals who work on jobs or projects alone as independent or together with a group of other individuals in an organization (a "small organization") or professionals who are employees of an organization, but who act for their own personal purposes as user of this site for seeking an employment opportunity. Individuals for whom we establish a Professional Account are referred to as "Professionals" and « Candidates » in this Agreement and this site.
Company (Hirer) Account. Businesses seeking Professionals for full or part time employment and direct conclusion of a work contract with professionals in their capacity as employer are eligible to register for a Hirer Account. Hirer Accounts may be used only for corporate businesses seeking to locate Professionals for work offered directly by such businesses. All businesses for which we establish a Hirer Account are referred to as "Hirers" or « Companies » in this Agreement. Employees of Hirer may use hirer account if such written contract has been signed between us sand this particular Hirer to whom we have provided the authorization such that his account can be used by his employees. Such employee of hirer to whom a permission has be granted for his employees to use his account acts as Hirer and represent his organization has to put his personal contact information for each position he/she advertises and is only eligible to use hirer account if specifically this is stated in our contract with the hirer, otherwise each employee of a hirer must have a separate Account. Employees of a hirer who are eligible to use of hirer account could only be located at the same business location of hirer, i.e at the same city, and country and working at the same adress of business institution as the hirer who has an account with us with the special right of use by his employees. By registering for an Account, you represent and warrant that (a) you are eligible for the Account that you have designated in the registration process, as set forth above; (b) the information that you include as part of the registration process is accurate, complete, and not misleading; and (c) if you are registering as a Hirer, you have the necessary authority to bind your organization to this Agreement. If your circumstances change such that you no longer are eligible for your Account, you will promptly notify us and we will terminate your Account. We reserve the right to investigate, at our own discretion, any activity that may violate this Agreement, including but not limited to a Hirer's failure to accurately identify itself as an employee.

5. FEES AND PAYMENTS
We may at any time amend our pricing policy for some or all of the services provided, and we may or may not notify you in advance of any such amendments. The pricing that is applicable to you is the pricing that is in effect in these terms of service on the date of any applicable transaction. If you continue to use your Account, you signify your acceptance of the amended pricing policy and agree to pay us all charges accrued by you under the amended pricing policy.
You are responsible for obtaining at your expense all hardware, software, and services required to access your Account.
If you are a Hirer, you can let Brite-Klissourska Brooks do the work of sourcing, screening and qualifying professionals for you by selecting a BriteBrooks type of account. Selecting such an account you oblige to pay a fee which is a percantage of year salary of the candidate you hired using our services. This fee is payable upon conclusion of contract with the candidate you hire using our services. We do not need to have an express written agreement with you and you accept our hiring fees as deifined in our general conditions.
Brite-Klissourska Brooks charges Hirers dependent on type of hirer account. Single account is an account where hirer pays for each position he advertises. Once a single type of account is approved with a hirer, each time hirer submits a postion he is automatcially billed for the position submitted. He has the obligation to respect the delays of payment. Upon hiring of a candidate by a single user hirer the hirer pays a flat rate fee per hired professional , which is independent on year salary, and defined at registration. Annual user hirer pays once a unique fee for the whole year and can submit unlimitted number of positions and use our recruitment management adminsitrative and publishing system.
Annual users are contacted by administrator after they select annual user status and their status and modalities of contract are confirmed in writing.
6. LINKS TO OUR SITE
We grant you full permission to link to the front page of the Site using a text link, but not to (a) frame the Site; (b) "deep-link" to any web page on the Site other than the front page; or (c) use any of our trademarks or logos without our prior written permission. You acknowledge and agree that we do not pay referral fees for any links you may make to the Site unless you enter into a separate agreement with us.
You agree not to use any robot, spider, automated collection mechanism, or any manual process to monitor or copy the web pages comprising the Site or the content contained therein without our prior written permission.
7. DISPUTE RESOLUTION
Any disputes regarding arrangements between Professionals and Hirers (including without limitation disputes regarding services and payment) remain solely between Hirers and Professionals. We are not involved in any transactions between you and any other users of the Site. You acknowledge and agree that Brite-Klissourska Brooks will not be a party to any such dispute or be obligated to take any action or refrain from taking any action toward resolving any such dispute. If you have a dispute with any other users of the Site, you hereby release us (and our agents and employees) from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, related to such dispute. You also agree that you are waiving all benefits and rights under any statute or common law principle of similar effect in any jurisdiction.
8. FEEDBACK
We will treat any feedback or suggestions you provide to us as non-confidential and non-proprietary. Please do not submit confidential or proprietary information to us unless we have mutually agreed in writing otherwise. Feedback can be sent via our feedback form.
9. OWNERSHIP
You agree that as between you and us, all content, software, trademarks, logos, hard codes, source codes and everything else hosted on this Site are our valuable intellectual property and commercial trade property of Brite-Klissourska Brooks. All rights to our content, software, services, concept of services, integrity of service platform, or parts their of and server information are reserved. All reproduction in whole or in part of the text or illustrations on this Site, by any means whatsoever and without our prior written consent, is prohibited.
10. DISCLAIMER OF WARRANTY
THE SITE, AND THE CONTENT, SERVICES, PRODUCTS, AND INFORMATION RELATED THERETO, ARE PROVIDED "AS IS" AND WITH ALL FAULTS, AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. WE DO NOT MAKE ANY REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, AS TO THE ACCURACY, TIMELINESS, OR COMPLETENESS OF ANY INFORMATION ON THE SITE (INCLUDING WITHOUT LIMITATION ANY INFORMATION PROVIDED BY USERS, OR ANY JOB DESCRIPTIONS/SOLICITATIONS, PROPOSALS, APPLICATIONS OR USER PROFILES), NOR DO WE UNDERTAKE TO VERIFY, UPDATE OR CORRECT SUCH INFORMATION. WE DO NOT GUARANTEE CONTINUOUS OR UNINTERRUPTED ACCESS TO YOUR ACCOUNT AND MAKE NO WARRANTY AS TO THE OPERATION, FUNCTIONALITY, OR AVAILABILITY OF THE SITE. WE DO NOT GUARANTEE ANY RESPONSE RATE TO ANY JOBS/SOLICITATIONS, APPLICATIONS OR PROPOSALS, NOR DO WE MAKE ANY WARRANTIES WITH RESPECT TO THE SERVICES OF ANY PROFESSIONAL, THE PAYMENT BY ANY HIRER OF FEES OR PAYMENTS IN CONNECTION WITH ANY JOB, OR THE SUCCESS OF ANY PROJECT. ANY USE OF OR RELIANCE UPON THE SITE, OR ANY INFORMATION OBTAINED THEREFROM, IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU AGREE THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES RESULTING THEREFROM.
11. INDEMNIFICATION
You agree to indemnify and hold us, our customers and business partners harmless from all losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) that we may incur as a result of any claims, suits, actions, or proceedings arising out of or related to Your Content or your breach of this Agreement, including without limitation any claims of intellectual property infringement, defamation, and trade secret misappropriation, and claims under any business tort theory.
12. LIMITATION OF LIABILITY
IN NO EVENT WILL WE OR OUR SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INDIRECT, EXEMPLARY, SPECIAL OR INCIDENTAL DAMAGES, INCLUDING ANY LOST DATA AND LOST PROFITS, ARISING FROM OR RELATING TO THIS AGREEMENT OR THE SITE, EVEN IF WE AND/OR OUR SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR (AND OUR SUPPLIERS') TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THIS AGREEMENT OR THE SITE, WHETHER IN CONTRACT OR TORT OR OTHERWISE, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID TO US BY YOU IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY; OR (B) ONE HUNDRED SWISS FRANCS. THE FOREGOING LIMITATION IS CUMULATIVE, WITH ALL PAYMENTS COUNTING TOWARD SATISFACTION OF THE LIMIT. Swissjobjournal.com is only a venue. This web site acts as a venue for employers to post job opportunities and candidates to post resumes and does not screen or censor the listings offered. We do not have control over the quality, savety or legality of the jobs or resumes posted, the thruth or the accuracy of the listings, the ability of employers to offer jobs to candidates, or the ability of the candidates to fill job openings. In addition note that there are risiks including but not limitted to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses.You assume all risks associated with dealing with other users with whom you might come into contact using our services and through the Web Site. Because user notification is difficult we can not and do not confirm that each user is who they claim to be. In no event should we or our suppliers liable for any consequental, indirect, exemplary, speical or incidental demages including any lost profits to other on-line suppliers or publishers, because of the concept of service, content and functionality of this SITE and any elements of this SITE and its SERVICES. And our total cummuliative liability in connection of this Agreement or this Site is as defined above in 12. A and 12B.
13. TERMINATION
We reserve the right to investigate, at our own discretion, any activity that may violate this Agreement. We may terminate this Agreement and your Account immediately if you breach this Agreement, if you infringe third party intellectual property rights, or if we are unable to authenticate any information you provide to us. Alternatively, you agree that we may remove some or all of Your Content (or public access thereto) at any time without notice. Following termination of your Account, we may remove some or all of Your Content from our servers or elect to retain it, at our sole option. Any payment obligations incurred prior to termination of this Agreement, and other obligations as defined int his Agreemnet will survive termination or expiration for any reason.
14. AMENDMENT
We may amend this Agreement by posting the amended version on the Site and making the amended Agreement available via a link from our home page. You agree that your continued use of the Site after such amendment indicates your acceptance of any such amendment. Otherwise, this Agreement may not be amended except in a writing signed by both parties.

16. GENERAL
You and Brite-Klissourska Brooks are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in force. Our failure to act with respect to a breach by you does not waive our right to act with respect to subsequent or similar breaches. We will not be liable for any delay or failure to perform resulting directly or indirectly from any causes beyond our reasonable control. Except as expressly stated otherwise, any notices will be given (a) by certified mail, postage prepaid and return receipt requested to the address provided below (in the case of notices to us); or (b) by e-mail or certified mail to the address you provided to us during the registration process (in the case of notices to you); (c) or such other addresses as the parties may specify by giving proper notice under this Agreement. Notice will be deemed given three (3) days after the date of mailing, or, in the case of e-mail, one (1) hour after the time of sending. You may not assign this Agreement to any third party, and any purported attempt to do so will be null and void. We may freely assign this Agreement. This Agreement sets forth the entire understanding and agreement between you and us with respect to the subject matter hereof and supersedes all prior agreements, communications, and understandings, both written and oral, about its subject matter. You agree that you have not relied on any representations that are not set forth in this Agreement.

Since Siwssjobjournal is a career site, we give you the option of putting your resume in our database. There are three ways of doing this:
We attempt to limit access to our searchable resume database (or copies thereof) only to paying employers, recruiters, hiring managers, and human resource, but cannot guarantee that other parties will not gain access to this database. We are not responsible for the use made of resumes by third parties who access such resumes while they are in our searchable database. You may remove your resume from our searchable database at any time. However, employers, recruiters and others who have paid for.
17.2. Security
Brite-Klissourska Brooks has implemented reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes.

We may disclose and transfer information to a third party who acquires all or a substantial portion of Brite-Klissourska Brooks business,and recruitment service platform whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets. In addition, in the event we become the subject of a bankruptcy proceeding, whether voluntary or involuntary, we or our trustee in bankruptcy may sell, license or otherwise dispose of such information in a transaction approved by the bankruptcy court.
We may also share aggregated anonymous information about visitors to each of its Web sites (for example, the number of visitors to our SITE with its clients, partners and other third parties so that they may understand the kinds of visitors to this site and how those visitors use the site.
In our capacity of a recrutment and placement service we act to share only with hirers (companies) as defined in this agreement your information or parts their of for purpose of fixing an interview between you and hirer, or evaluating potential opportunity for a work contract between candidate and hirer, or for putting you in contact with Hirer. In the CV book the access of unregistered users is restricted. We make all the measures upon registration of a hirers account to confirm hirer information and account before we permit him to post job openings and use the system as a hirer. However, we can not guarantee the capacity of hirer to represent an organization and to act as a hirer, and we can not guarantee that allways hirer is who he claims to be.
For purpose of assisiting candidates in their job search all submitted applications to us, via e-mail, paper file or otherwise can be introduced in our candidates data base and made available for search by companies without name and contact information, as skills CV, professional CV or hidden CV. We can submit applications introduced by us for Candidates and apply them for positions, via a porfessional CV which does not contain name and contact information of Candidate, and receive answers and requests of Companies for these Candidates who have been introduced by us. We can put in contact Hirers and Candidates which do not have a registered account with us. Displaying positions of Hirers, is not limitted to Hirers which do have a registered Company account with us, and as we observe the job market we can obtian details of position via phone or other means from Hirers who do not have a registered Company account with us, and post them. When you submit your CV to us in paper, by e-mail, or by registering for a professional account you agree that you grant us all rights to search for employment opportunities for you and to put you in contact with Hirers. When you submit your CV to hirer, i.e. apply through the platform here your professional CV will be submitted to hirer by default. Professional CV does not contain your name and contact information.
We make all the efforts to assist Candidates in their Job search by protecting their name and contact information, however, we cannot guarantee that unauthorized third parties or hirers will never be able to defeat those measures or use your personal information for improper purposes. We can use any lawfull measures for dealing with candidates files in our capaicty of a placement agency for the purposes of serving Candidates and Hirers. Candidates applied to Hirer position posted in Swissjobjournal.com have the right and could simultaneously apply at as many positions and to different Hirer as they will desire. We can not guarantee that applicants are exclusively applied to a given Hirer, even if they answer a press or on-line job positing of such Hirer, when using our services. The platform for Professionals and Hirers is an interactive platform and Candidates and Hirers have the right to act as the consider best for their objectives and interest to conclude a contract between each other.
